Andrea M. Kimball

Andrea Kimball is a trial lawyer who practices Business and Commercial Litigation in State and Federal Courts, including contracts, product liability, pharmaceuticals, unfair competition, trade secret and intellectual property litigation, lender liability and other business litigation. As a former federal court law clerk, Ms. Kimball appears regularly in federal courts throughout the west coast.

Recent Work/Representative Matters

In 2007, successfully represented leading stone veneer manufacturer Eldorado Stone LLC in competitor dispute involving trade secret misappropriation, trademark and copyright, infringement, unfair competition and intentional interference with economic relations. A three week federal jury trial resulted in a verdict for Eldorado on all counts - awarding over $23 million in compensatory and punitive damages as well as injunctive relief, litigation costs and attorneys' fees. Continued representation of Eldorado and parent company Headwaters Inc. in intellectual property and commercial matters.

Represented Fortune 100 company in product liability (medical device) and breach of contract case that resulted in a multimillion dollar settlement.

Along with another Luce Forward partner, obtained numerous favorable summary judgment rulings for pharmaceutical defendants in product liability, warranty and unfair business practice cases.

Successfully represented real estate developer and supplier clients in breach of contract matters - in litigation, mediations and arbitrations.

Served as local counsel to multiple companies involved in litigation in California including general commercial litigation, lending, patent, trademark and copyright infringement.
